Lasting Power of Attorney

Sadly, injury and illness can happen to anyone of any age at any time. A Lasting Powers of Attorney means that your wishes are known and can be carried out if you no longer have capacity to make decisions.

Why do I need a Lasting Power of Attorney?

A Lasting Power of Attorney is a document that allows you to appoint someone who would be called your Attorney to make decisions on your behalf.

There are two different types of Lasting Power of Attorney:
Financial Affairs gives your Attorneys the authority to:
Run your bank and savings accounts
Make or sell investments
Pay your bills
Buy or sell your house
Health and Care Decisions gives your Attorneys the authority to specify:
The type of health care and medical treatment you receive, including life-sustaining treatment
Where you live
Day-to-day matters such as your diet and daily routine

By choosing who you want to make decisions for you the LPA puts you in control of decisions eventually being made on your behalf 

Points to note about a Lasting Power of Attorney:
  • LPA is only valid if you have the capacity to make it and have not been pressured to make it.
  • An LPA Can be revoked or amended if you have capacity to do so.
  • An LPA needs to be registered before it can be used. 
  • An LPA Financial Affairs can be used to assist you immediately or used when you have lost capacity. 
  • An LPA Health and Care Decisions can only be used once you have lost capacity
