Probate is a term commonly used to describe the
administration of a person's estate after they die.
At Sandersons we understand that for bereaved
relatives and friends, the process of obtaining
probate can be worrying.

Dealing with probate

Probate is the legal process of dealing with a deceased person's estate and involves applying for a Grant of Probate on behalf of the executors of the estate. If there is no will then a Grant or Letter of Administration can be applied for on behalf of the deceased's nearest relative.

Once the grant has been obtained, we can then deal with the collection of the assets of the estate, discharge all liabilities including the Inheritance Tax (if applicable), paying funeral expenses and distributing the assets pursuant to the terms of the will or in accordance with the rules of intestacy. 

Some of the probate tasks which have to be completed, and that we can do for you are:
  • Establish the full extent of the estate.
  • Apply for Probate.
  • Pay Inheritance Tax (penalties may be charged for late payment).
  • Answer HMRC enquiries regarding the deceased’s estate.
  • Liaise with DWP - potential claims against the estate.
  • Register Probate with banks/building societies etc.
  • Close accounts/sell property/sell or transfer shares/claim life insurance policies/appropriate assets.
  • Pay all liabilities including funeral.
  • Deal with Capital Gains Tax and Income Tax.
  • Prepare Estate Accounts for approval.
  • Distribute the Estate
